My DH's ex-wife is marrying a man in a few weeks who was recently released from jail for 3rd degree rape in New York State...She has told us that he is not to be around children under the age of 18 and he is not to be on the internet or go out anywhere that sells alcohol, etc... we know he is supposed to be registered as a tier 1 sex offender but the do not list them on the online registries.

Anyway, DH and I are trying to get custody of his 3 year old daughter, she doesn't know yet and we know he is on probation but we only know what she tells us and we know its not the whole truth, what we were wondering is if conditions of probation are a matter of public record or not?  If so, how would we go about finding out so we know exactly what his conditions are.

I would start my just making phone calls. You'll find some one that is willing to talk and help you.

They should be public record. I'm not sure where you would find out though. Here in Missouri, we have an online system called casenet. You would probably have to call the circuit clerk's office to find out where/how you can get that information. Or call the probation and parole office. But I am fairly certain it is a matter of public record as I can access any of that information here in Missouri.

google your state's department of corrections, it may be listed on there if you type in his name. it all should be on public record. if it's not there try the city clerk's office or the police department.
